Refund Policy
1. General Policy
At CleverSignalForge, we are committed to delivering high-quality digital services. Refunds are evaluated on a case-by-case basis, taking into account the project scope, milestones completed, and the nature of the service provided.
2. Pre-Project Cancellation
If a project is cancelled before any work has commenced, a full refund of any advance payment will be issued within 14 business days. Cancellation must be communicated in writing to [email protected].
3. In-Progress Projects
For projects that have already commenced, refunds will be calculated based on the proportion of work completed. Milestones already delivered and approved are non-refundable. Any prepaid amounts for undelivered milestones will be refunded proportionally within 14 business days of the cancellation request.
4. Delivered Services
Once a service has been fully delivered and accepted, no refund will be issued. However, if the delivered work materially deviates from the agreed specifications, we will first attempt to rectify the issues at no additional cost before any refund discussion.
5. Dispute Resolution
In the event of a dispute regarding refunds, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal remedies. Disputes shall be governed by the laws of the Federal Republic of Germany.
Terms of Service
1. Acceptance of Terms
By accessing and using the services provided by CleverSignalForge, located at 23898 Sandesneben, Buchenweg 4, Germany, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not engage our services.
2. Scope of Services
CleverSignalForge provides digital studio services including, but not limited to, full-stack platform engineering, landing page architecture, CMS development, e-commerce solutions, API integration, performance optimization, UI/UX design, and cloud infrastructure deployment. The specific scope, deliverables, timelines, and pricing for each project are defined in individual project proposals and agreements.
3. Payment Terms
Payment terms are specified in each project proposal. Standard payment structure requires 50% advance payment before project commencement and 50% upon final delivery. Invoices are payable within 14 days of issuance. Late payments may incur a statutory interest charge of 9 percentage points above the base rate per annum.
4. Intellectual Property
Upon full payment, all intellectual property rights for the delivered work are transferred to the client. CleverSignalForge retains the right to display completed work in its portfolio and case studies unless explicitly restricted in the project agreement. Pre-existing code libraries, frameworks, and tools used during development remain the property of CleverSignalForge.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the course of the project. This obligation survives the termination of the business relationship and remains in effect for a period of 24 months.
6. Limitation of Liability
CleverSignalForge shall not be liable for any indirect, incidental, or consequential damages arising from the use of delivered services. Our total liability shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
7. Governing Law
These Terms of Service are governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in the district where CleverSignalForge is registered.
8. Amendments
CleverSignalForge reserves the right to amend these Terms of Service at any time. Changes will be communicated through the website or directly to clients with active projects. Continued use of our services after notification constitutes acceptance of the amended terms.
